1. General

1.1 These terms and conditions apply to all activities, exhibitions, events, submissions, and purchases at Ballon Rouge.

1.2 By visiting the gallery, participating in an exhibition, submitting a proposal, or purchasing a work, you agree to these terms and conditions.

1.3 Ballon Rouge reserves the right to amend these terms and conditions. The most recent version is always available on our website or upon request.

2. Conditions for exhibitors / photographers

2.1 Confirmation and cancellation

  • Participation in an exhibition is confirmed by email. Once participation has been confirmed, this agreement is binding.

  • After confirmation, cancellation is no longer possible without costs. Any expenses already incurred may be charged to the exhibitor.

2.2 Delivery and presentation

  • Exhibitors are responsible for the professional production, printing, framing, and timely delivery of their work.

  • All works must be ready to be hung or installed upon arrival.

  • Ballon Rouge reserves the right to refuse works that are technically inadequate or in poor condition.

2.3 Sales and commission

  • Artists receive the agreed-upon share of any sales, and Ballon Rouge retains the agreed commission. Commission rates are specified in our open calls or communicated to the artist beforehand.

  • Ballon Rouge handles the sales process and delivery to the buyer and provides an overview of sales after the exhibition.

  • The sales price is agreed upon in advance and remains fixed throughout the exhibition.

  • If a sale takes place within three months after the exhibition as a direct result of the exhibition or our mediation (for example through visitors, collectors, or contacts introduced by Ballon Rouge), we ask you to inform us. In this case, the same commission agreement applies.

  • You are responsible for issuing a valid invoice. A Chamber of Commerce or VAT number is not required, but an invoice must be provided.

2.4 Liability and insurance

  • Ballon Rouge is not liable for loss, damage, or theft of works during transport or the exhibition period.

  • Exhibitors are responsible for insuring their own work if desired.

2.5 Conduct and damage

  • Exhibitors are expected to handle the space and facilities with care.

  • Any damage to the gallery or its materials caused by exhibitors will be charged accordingly.

2.6 Image use and personal data

  • Ballon Rouge may photograph or film the exhibition and the space, including exhibited works, and use this material for promotional purposes on the website, social media, and printed materials.

  • Personal data (such as name and email address) will only be used for communication related to the exhibition and newsletters from Ballon Rouge.

2.7 Termination by Ballon Rouge

  • Ballon Rouge reserves the right to terminate an exhibition or participation if agreements or these terms and conditions are not met.

3. Conditions for exhibition proposals and open calls

3.1 Exhibition proposals can only be submitted via the official submission form on our website. Proposals submitted without payment will not be considered.

3.2 Due to the volume of submissions, Ballon Rouge cannot enter into correspondence about individual proposals. Decisions regarding selection are final.

3.3 Submitting a proposal or participating in an open call does not guarantee selection or an exhibition. Participation is entirely voluntary and at the artist’s own initiative.

3.4 If you do not agree with these conditions or with the submission process, you may choose not to participate.

3.5 Exploratory conversations, meetings, or discussions about possible exhibition options do not constitute a commitment from Ballon Rouge. These conversations are part of an initial orientation phase and may take place without leading to an exhibition.

3.6 Ballon Rouge reserves the right to reconsider or withdraw from a proposed collaboration if, upon further reflection, the work, direction, or audience is no longer considered a suitable fit with the gallery’s vision or program.

4. Conditions for visitors

4.1 Conduct in the gallery

  • Visitors are expected to treat the space, exhibited works, and other visitors with respect.

  • Touching artworks is not permitted unless explicitly stated.

4.2 Photography

  • Photography is allowed unless stated otherwise.

  • When publishing images, proper credit to the artist is required and copyright must be respected.

4.3 Damage

  • Visitors who cause damage to artworks or the gallery space will be held liable for the costs.

4.4 Safety and liability

  • Visiting the gallery is at your own risk. Ballon Rouge is not liable for personal injury or loss of personal belongings.

5. Conditions for buyers

5.1 Purchase and payment

  • Purchases are binding after written confirmation. In the event of cancellation, any costs already incurred (such as printing or production) may be charged.

  • Payment is made via the method specified by Ballon Rouge.

5.2 Delivery and ownership

  • The artwork remains the property of the artist until full payment has been received.

  • Delivery is arranged in consultation; transport can be coordinated by Ballon Rouge at the buyer’s expense.

5.3 Copyright

  • Copyright remains with the artist after purchase.

  • Reproduction or commercial use of the artwork is not permitted without written permission from the artist.

5.4 Returns

  • Purchased artworks cannot be returned or cancelled unless otherwise agreed or required by law.

6. Final provisions

6.1 In situations not covered by these terms and conditions, Ballon Rouge will decide.

6.2 All agreements are governed by Dutch law.
